Knightsbridge Litigation Funding Pty Ltd's current investment opportunity is an Australian unit trust established for a single purpose: to fund the legal costs of a class action currently before the Supreme Court of Victoria. Wholesale investors subscribe for units in the trust, and their capital is deployed against the case under a defined mandate.

 

The structure is built around independence and oversight. Investor funds are held by Equity Trustees as independent custodian, separate from Knightsbridge Litigation Funding Pty Ltd. The fund's accounting is handled independently by Findex, and every legal cost is verified by Pattison Hardman before it is paid.

 

Knightsbridge manages the investment and the trust's governance, while Levitt Robinson runs the litigation itself alongside the lead plaintiffs.

 

If a claim succeeds, proceeds are distributed under a defined waterfall set out in full in the Information Memorandum, which determines the order in which costs, the funder and investors are paid.

Returns are driven by the outcome of the underlying litigation; specifically, how much is recovered and the terms on which the case settles or is decided. Because the return is tied to a legal result rather than to markets, performance is independent of interest rates, share markets and the economic cycle, and is realised when the case resolves rather than over a long hold. 

 

Because the case is already well progressed, investors are entering at a stage where the legal groundwork is largely laid. The size of any recovery, and whether it comes by settlement or judgment, determines the return, and the modelling points to the potential for a significant multiple on invested capital across a range of recovery scenarios within a defined 12 to 24 month window.

 

The full scenario analysis, including the figures, assumptions and break-even point behind each outcome, is provided to wholesale investors on request. As with any litigation funding investment, returns are not guaranteed, outcomes depend on the level of recovery achieved, and capital is at risk.

The funder covers the legal costs of a case, such as solicitor and barrister fees, expert reports and trial preparation, in exchange for a portion of the settlement or judgment if the case wins.

The typical investment horizon ranges between approximately 12-24 months, reflecting the time required for litigation matters to progress through the legal process and reach settlement or judgment. Each matter is unique and timelines may vary.
